1. Acceptance of Terms
By accessing or using RevPhoenix AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
RevPhoenix AI is a sales intelligence platform that connects to your CRM, analyzes pipeline activity, detects commitment gaps, and provides AI-powered recommendations to help sales teams close more deals.
3. Free Trial
We offer a 7-day free trial with limited usage. No credit card is required to start a trial. Trial usage is limited to 25 AI analyses and 30 minutes of transcription. At the end of the trial period, you must upgrade to a paid plan to continue using the Service.
Trial data is retained for 30 days after expiration then permanently deleted.
4. Subscriptions and Billing
Paid subscriptions are billed monthly. Prices are per seat per month. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
Early adopter pricing: Customers who subscribe during our early adopter period lock in their discounted rate for as long as their subscription remains active without a lapse.
Failed payments: If payment fails, we will retry up to 3 times over 14 days. If payment is not resolved, your account will be suspended.
5. Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Share your account credentials with unauthorized users
- Attempt to reverse engineer or copy the Service
- Use the Service to process data you do not have rights to
- Circumvent usage limits or billing
7. CRM Data and Integrations
By connecting your HubSpot account, you grant RevPhoenix AI read access to your CRM data solely for the purpose of providing the Service. We do not modify, delete, or write to your CRM data. You may disconnect the integration at any time.
You represent that you have the authority to connect your company's CRM account to RevPhoenix AI.
8. AI Analysis Disclaimer
RevPhoenix AI provides AI-generated insights and recommendations. These are advisory in nature and do not constitute professional sales, legal, or financial advice. We do not guarantee specific sales outcomes. You are responsible for all decisions made based on RevPhoenix AI insights.
9. Limitation of Liability
To the maximum extent permitted by law, RevPhoenix AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost deals, arising from your use of the Service.
Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Intellectual Property
RevPhoenix AI and all related technology, code, and content are owned by RevPhoenix AI. You retain ownership of your CRM data. You grant us a limited license to process your data solely to provide the Service.
11. Termination
We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or any conduct that we determine to be harmful to other users or the Service.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will provide 30 days notice for material changes.
